1) Services & Booking

What we do: Real estate media services, including photography, video, aerial/drone, floor plans, and property websites (the “Services”).

How to book: Book online through our website or by contacting us at [hello@truehomephotos.com / [925-234-5773].

Availability: Dates and times are first-come, first-served and not guaranteed until confirmed.

Preparation: Client is responsible for property readiness (cleaned, staged, accessible, utilities on). A [15-minute] grace period applies; additional wait time or reshoots may incur a [ $20 / 15 min ] fee.
2) “First Shoot Free” Offer

Who qualifies: New clients who are licensed real-estate professionals within [20 miles] of [Brentwood]; residential properties up to [4,000 sqft]; weekdays [hours] only.

Limit: [10] free shoots per calendar month, subject to availability.

What’s included: Same-day photo delivery, aerial orbit video, and a 2D floor plan (as advertised on the site).

No-shows / late cancels: Less than [24 hours] notice or a no-show voids eligibility for the free shoot and may result in a [$50] fee.

Non-transferable: Not redeemable for cash; one free shoot per client/team.
3) Pricing, Deposits & Payment

Packages: Current prices are shown on our website. Taxes/fees may apply.

Deposits: For returning clients, a $[75] non-refundable deposit is required to secure a booking; balance due on delivery of media unless otherwise stated.

Payment methods: [Wix Payments/Stripe/PayPal] and other approved options at checkout.

Late payment: Past-due balances may incur a [1.5% per month or $15 minimum] late fee until paid.

Chargebacks: Filing a chargeback without first contacting us to resolve an issue may result in suspension of future services.
4) Rescheduling, Cancellations & Weather

Client reschedule/cancel: Please provide [24 hours] notice. Short-notice changes may incur a [ $50 ] fee.

Weather: We may reschedule at no cost for unsafe or poor conditions (heavy rain, lightning, high winds, FAA restrictions). If client insists on proceeding against advice, results are not guaranteed and reshoot fees may apply.

Property not ready / access issues: If we cannot complete the shoot due to readiness or access problems, a trip/standby/reshoot fee may apply.
5) Turnaround, Revisions & File Delivery

Turnaround: Photos same day (typical); reels within 48 hours; floor plans within 24–48 hours unless otherwise stated. These are targets, not guarantees.

Delivery method: Download links or property websites via [Aryeo/Drive/Your system].

Revisions: Up to [3] minor edits within [7] days of delivery at no charge (e.g., exposure, white balance, basic sky replacement). Additional edits or advanced retouching are [ $20 / image or $75 / hour ].

Archiving: We retain project files for [12–24 months] for re-delivery; after that, files may be archived or deleted.
6) Intellectual Property & License to Use

Ownership: We retain all copyrights to media we create.

License to client: Upon full payment, we grant a non-exclusive, non-transferable license to use the delivered media solely to market the specific property and your own real-estate services during the listing term (including MLS, portals, social media, print, brokerage sites).

Limitations: You may not sell, sublicense, or transfer the media to third parties (e.g., new listing agents, stagers, builders) without our written consent or a separate license.

Edits: Cropping and resizing are permitted; heavy edits, filters, or AI alterations require our approval.

Broker changes / re-lists: If the property is re-listed with another agent, a new license fee may apply.

Buy-out option: A broader or perpetual license can be purchased—contact us for pricing.
7) Portfolio Display
We may display select images/videos in our portfolio (website, social media, marketing).
Opt-out: Email [hello@truehomephotos.com] with subject “Portfolio Opt-Out” and the property address within 7 days of delivery.
8) Drone & Safety Compliance

FAA Part 107: All drone work is performed in compliance with applicable laws and airspace rules. We may decline or postpone flights for safety, legality, or airspace restrictions (including LAANC denials).

Client permissions: Client represents they have the owner’s permission and all necessary access/permits. Client is responsible for HOA, building, or site-specific rules.
9) Client Responsibilities & Representations

You warrant you have authority to grant access and to license the media for property marketing.

You will ensure pets are secured, alarms disarmed, and any hazards disclosed.

You will review deliverables promptly and communicate any issues within [5] business days.
10) Disclaimers

Services are provided on an “as-is” and “as-available” basis. We do not guarantee specific sales outcomes, showing volume, or time-on-market.

Colors and brightness may vary between screens and prints.

Turnaround times are good-faith estimates and may shift due to workload, weather, access, or technical issues.
11) Limitation of Liability
To the maximum extent allowed by law, our total liability for any claim arising out of the Services will not exceed the amount you paid for the specific job at issue. We are not liable for any indirect, incidental, special, or consequential damages (including lost profits or opportunities).
12) Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, or costs arising from your misuse of the media, lack of authority to grant access, violation of third-party rights, or breach of these Terms.
13) Third-Party Tools & Links
Our site may include third-party tools or links (e.g., payment processors, file delivery, analytics). We are not responsible for their content or practices. Your use of those services is subject to their terms.
14) Privacy
Our Privacy Policy explains how we collect and use personal information. By using our Services, you also agree to the Privacy Policy.
15) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Material changes will be posted on this page.
16) Governing Law
